Deferred Action for Childhood Arrivals (DACA): What Happens Now?

The Trump administration on Tuesday formally announced the end of the Deferred Action for Child Arrival, or DACA — a program that had protected nearly 800,000 young undocumented immigrants also known as “DREAMers,” brought to the United States as children from being deported.
The Department of Homeland Security will stop processing any new applications for the program as of Tuesday, September 05, 2017 and rescinded the Obama administration policy.
Here’s What you Need to Know About the Program:
DACA allowed individuals who were brought to the United States as children or teens before mid-2007 to apply for protection from deportation and work permits if they met certain requirements. Beneficiaries had to be under the age of 16 upon entering the country; no older than 31 as of June 15, 2012; lived continuously in the U.S. since mid-2007; be enrolled in high school or college, already have a diploma or degree, have a GED certificate or be an honorably discharged veteran of the U.S. military; and have no felony criminal convictions, significant misdemeanor convictions, no more than three other misdemeanor convictions or otherwise pose a threat to national security or public safety.
President Obama created DACA through a 2012 executive order. The program did not provide lawful immigration status. Instead, through what the Obama administration characterized as the exercise of prosecutorial discretion, it granted a deferral from possibly being removed from the U.S. to those who qualified along with work permits. The deferrals and permits were granted for two-year periods and could be renewed for additional two-year periods.
In the five years since DACA was enacted, the nearly 800,000 individuals who received the protections have started families, pursued careers, started their own businesses, and studied in schools and universities across the U.S.
Now What?
The Trump administration is giving Congress until March 05, 2018 to act in order to preserve the program’s protection before the DACA recipients begin losing their status. Anyone whose status expires by March 05, 2018, has until October 05, 2017, to apply for a two-year permit, and those applications will be processed.
What is Going to Happen to Pending DACA Initial Requests and Pending DACA Renewal Requests?
USCIS will process on an individual case-by-case basis properly pending DACA initial requests and associated applications for employment authorization documents (EADs) that have been accepted as of September 05, 2017.
Additionally, USCIS will process properly filed pending DACA renewal requests and associated applications for EADs from current beneficiaries that have been accepted as of September 05, 2017, and from current beneficiaries whose benefits will expire between September 05, 2017 – March 05, 2018, that have been accepted as of October 05, 2017.
Individuals who have not submitted an initial request under DACA as of September 05, 2017 may no longer apply. USCIS will reject all applications for initial requests received after September 05, 2017.
What is Going to Happen to Current DACA Holders?
Current DACA recipients will be permitted to retain both the period of deferred action and their EADs until they expire, unless terminated or revoked. Current law does not grant any legal status for the class of individuals who are current recipients of DACA. Recipients of DACA are currently unlawfully present in the U.S. with their removal deferred.
What Happens when an Individual’s DACA expires?
Without the program’s protections, the immigrants are considered subject to removal from the United States and would no longer be able to work legally.
What May Happen?
If Congress does not act, then individuals formerly protected would lose their ability to work, study, and live without fear in the U.S. According to officials from the Department of Homeland Security, Dreamers would not be high priorities for deportation, but they would be issued notices to appear at immigration court if they are encountered by federal immigration officers. Further, there are no plans for DHS to use personal information, including home addresses, of Dreamers who registered for work permits to aid in deportation operations unless there is a concern over national security, DHS officials said.
The pressure over the Dreamers now shifts to Congress, where several new proposals have been put forward. One of which includes the Bridge Act, a bipartisan bill with 25 co-sponsors that would extend DACA protection for three years to give Congress time to enact permanent legislation. However, the White House and conservative Republicans are likely to demand additional provisions to boost border security, for example, funding for Trump’s proposed border wall or measures to restrict legal immigration
Children who were brought into the U.S. at young ages by their parents were branded Dreamers for their inspiring stories and regarded by members of both parties as deserving of special status. Former President Barack Obama on Tuesday stated, “To target these young people is wrong—because they have done nothing wrong — It’s a political decision, and a moral question,” Obama wrote. “Whatever concerns or complaints Americans may have about immigration in general, we shouldn’t threaten the future of this group of young people who are here through no fault of their own, who pose no threat, who are not taking away anything from the rest of us.”
“This is not amnesty. This is not immunity. This is not a path to citizenship. It’s not a permanent fix, “Obama said. “This is a temporary stopgap measure.”
“I am here because of Immigrants! My parents came to the United States with the goal of giving their children the opportunity to succeed beyond their wildest dreams, I am a first generation Dominican-American who truly believes that our nation was built by immigrants and would not be what it is today without them! Dreamers are Americans in every single way except on paper; I support DACA and stand with Dreamers,” said Attorney Emely Ramirez of Wites & Rogers.
“To arbitrarily end the DACA program, which benefits our country as a whole, is contrary to our nations values and simply bad policy,” said Attorney Marc Wites of Wites & Rogers.

The case involved years of litigation, multiple appeals, and extraordinary courage from the victims and their families. This result stands as a powerful example of holding institutions accountable and seeking justice for survivors of childhood sexual abuse.

Sexual abuse and harassment against women is finally a prevalent topic in today’s news. From Fox News to Harvey Weinstein, from Bill Cosby to Fidelity Investments, strong, professional woman have come forward to face their abusers. For many, it took years of suffering, and unfortunately belated support of the public, to find the strength to come forward.
Back in 2005, four third-grade girls in Boca Raton, Florida, found the strength and courage to tell their parents about the sexual abuse they had been suffering at the hands of their third-grade teacher. Little did they know, or could they even appreciate at such a tender young age, their journey and fight for justice would last for 12 more years.
It is often said that the wheels of justice grind slowly. Here, it all began during the 2004-2005 school year, when teacher Blake Sinrod abuse 4 girls in his third grade class, all of South American decent and from families that had only recently moved to the United States. In court papers, the girls are referred to as the Janie Does to protect their identity. As reported in the Sun Sentinel, Sinrod touched them over and under their clothing on their private parts during reading and movie times, and when the other kids were outside at recess.
Unbeknownst to the Janie Does or their parents, this was not the first time Sinrod was accused of engaging in such horrific conduct. Two years earlier, during the 2002-2003 school year, another young girl – this time in Sinrod’s second grade class – of South American decent and with parents with limited English skills – had the courage to tell her parents that Sinrod was abusing her in the same fashion. The next day after telling her parents, they all went to the School to report it. According to the family, the Vice-Principal, however, refused to believe them, and forced the girl to return to Sinrod’s class. Instead, the family removed their daughter from the school, and moved to another county, hoping to avoid any confrontations with Sinrod and to quickly and quietly put the horror behind them.
During the 11-year litigation, the four Janie Doe Plaintiffs grew into young women. Over the years, they were interviewed by the police and government agencies, gave multiple depositions, and sat for a psychological exam given by the School Board’s expert witness. All the while, the case hung over the girls’ heads while it wound its way through Florida’s trial and appeals courts.

Marc Wites and Wites & Rogers became counsel in the case in 2011. By that time, the civil case was already 5 years old, having been filed in 2006. The criminal case against Sinrod had since been resolved, with Sinrod pleading guilty to a felony count of child abuse, and being forced to give up his teaching license and never again work with or around children. The State Attorney’s Office never explained why it resolved the case in this fashion.
Ultimately, the very school board that they fought against was on their side. Chuck Shaw, Board Chairman of the Palm Beach County School Board, stated at the public meeting approving the deal that “the settlement was absolutely appropriate.” While the School Board offered no explanation or apology for why it took so long to resolve the case, the Janie Does and their lawyer, Marc Wites , are hopeful that the Palm Beach County School Board will pay more careful attention to sexual abuse claims in the future, and, more importantly, take more aggressive steps to prevent such abuse before it occurs.
Media coverage of the case and settlement was widespread. The Sun Sentinel published many articles about the case authored by journalist Scott Travis, and the Sun Sentinel’s Editorial Board called upon the School Board to bane the “blame-the-victim legal defense”, stating that “Taking responsibility for your actions is a lesson we should learn by the time we finish kindergarten.”
As attorney Marc Wites of Wites & Rogers told People Magazine, “I would just say that it’s unfortunate that it took 11 years of litigation to bring this case to a conclusion…an appeals process was happening simultaneously, so this took a very long time.” In the end, the 3.6 million dollar settlement Wites & Rogers obtained for their clients is reportedly one of the largest settlements in Palm Beach County School Board history.
The Janie Does hope to leave young girls and women across the country with a message. As detailed by People Magazine, one of the Janie Does explained it this way: “Many victims feel like it’s their fault and that they are accountable for what happened to them in some way. I’m here to say that it’s not your fault, and you are not alone. Don’t be afraid to speak up.”

The deadline to make a claim in the Cryptsy Class Action Settlement has passed. The Court has given final approval to the settlement, including the notice and claims administration process. You can read about the settlement at www.cryptsysettlement.com
If you missed the deadline, we may still be able to help you. Wites & Rogers and Silver Miller are pursuing a class action lawsuit against Coinbase to recover money for Cryptsy account holders. This lawsuit is pending in federal court in The United States District Court for the Southern District of Florida. In response to the lawsuit, Coinbase filed a motion to compel arbitration, which is designed to prevent Cryptsy account holders from suing Coinbase in court, and to prevent them from joining together in a class action. The federal court denied Coinbase’s motion to force the case to arbitration, and ruled that because Cryptsy account holders are not parties to any contract with Coinbase that they can pursue their claims in court.
You need not take any action at this time to be part of the Coinbase class action. If the Court certifies the case as a class action, Wites & Rogers and Silver Miller will post information on the Internet and make other efforts – which are subject to court approval – to advise Cryptsy account holders about the case. You can email your information (including your name, email address, physical address and phone number) to info@witeslaw.com, and we will send you updates about the case.

1. Many Door-to-Door Contractors Are Unlicensed or Uninsured

After major storms, dishonest contractors often travel from out of state to target distressed homeowners.

These contractors may:

Lack proper licensing or insurance

Disappear once paid

Perform substandard or incomplete work

If something goes wrong later, you may have no legal or financial recourse.

Always verify licensing and insurance before allowing anyone to work on your property.

2. Your Insurance Company Has the Right to Inspect the Damage First

Most insurance policies require that your insurer be given the opportunity to inspect certain types of damage before permanent repairs begin.

You are allowed — and required — to make emergency repairs to prevent further damage (such as tarping a roof or boarding windows).
However, non-emergency repairs (drywall, cabinets, plumbing, flooring) often must wait.

Starting repairs too soon can allow your insurer to argue that:

Damage was not properly documented

Coverage was forfeited

The claim should be denied

3. Some Policies Allow the Insurance Company to Elect the Repairs

Many homeowners are unaware that some insurance policies give the insurer the right to elect to repair the property.

If you:

Sign a contractor agreement too early

Prevent inspection

Begin unauthorized repairs

The insurer may claim you violated policy terms and attempt to deny coverage.

4. You Could Accidentally Sign Away Your Rights

Some door-to-door contractors use contracts that:

Assign insurance benefits

Lock you into overpriced repairs

Prevent you from choosing your own contractor

Limit your legal options

Once signed, these contracts can be extremely difficult to undo.

Hurricane Irma Insurance Tip: Water Damage Claims

After a hurricane like Irma, insurance companies often ask homeowners to explain how property damage occurred. How damage is described and how it is documented can have a significant impact on whether a claim is covered, delayed, or denied.

Why Word Choice Matters in Insurance Claims

Many homeowners and commercial property insurance policies:

Cover certain types of water damage

Exclude or limit coverage for flooding

Define “flood” differently than homeowners commonly understand

Because of this, policyholders should:

Describe what happened, not guess at insurance terminology

Allow the insurer to inspect and determine the cause

Avoid speculating about exclusions or policy definitions

So, for example, if a pipe breaks in your house causing water to cover the floor and damage your property, it is not a flood, and you should not call it one. How you describe the cause of your damages could have a big impact on whether your insurance company covers or tries to deny your claim. You should just describe the damage, and allow the insurance company to inspect and reach their own conclusions.

Victims of the Cryptsy fraud received good news this week in rulings from the two federal court cases. First, District Court Judge Kenneth Marra of The United States District Court for the Southern District of Florida granted final approval to the class action settlement reached with Vernon’s ex-wife and a minority Cryptsy shareholder. The Court praised the settlement and the attorneys involved including Class Counsel, Marc A. Wites of Wites & Rogers (www.wklawyers.com), and David C. Silver, of Silver Law Group (www.silverlaw.com), noting that Cryptsy’s founder and majority shareholder, Paul Vernon, shut down Cryptsy, fled the country for China, and has refused to respond to or otherwise participate in the lawsuit.
In connection with granting final approval to the settlement, Judge Marra also authorized the Court-Appointed Receiver, James D. Sallah, to proceed with the sale of real estate, the proceeds from which will be used to help fund the settlement .Plaintiffs in the Class Action, and the Receiver, contended that Vernon used monies obtained from cryptocurrency stolen from Cryptsy accounts, to purchase the home.
Co-Class Counsel, Marc Wites , explained that the Court’s approval of the settlement is a big step in the process of providing relief to the victims of Cryptsy’s fraud. “There is still a lot more work to do” said Wites, explaining that “we must now liquidate all of the assets that are part of the settlement fund, review all of the claims submitted by Cryptsy victims, and then make distributions.” Wites & Rogersis hopeful that distributions to victims will begin later this summer.
On another front, Cryptsy victims scored another victory in a separate, but related, class action brought against Coinbase. On Thursday, Judge Marra – who also presides over the Coinbase case – ruled that Coinbase could not force the class action claims of the Cryptsy victims to arbitration. Co-Class Counsel David Silver, remarked that “the Court ruling means that a party that does not sign a contract with an arbitration agreement, and does not agree to arbitration, cannot be forced to arbitration. This victory means that this case will be tried in public and resolved by a trial before a jury of Cryptsy victims peers.”
In denying Coinbase’s efforts to force the case to arbitration, the Court also refused to stay the case (which in layperson terms means to put in on hold or pause) while the Court-Appointed Receiver, Mr. Sallah (www.sallahcox.com), pursues claims in arbitration against Cryptsy. When the Court appoints a Receiver, explained Attorney Silver, the Receiver steps into the shoes of the company it was appointed to take over, so in this case Mr. Sallah, on behalf of Cryptsy, is suing Coinbase. Since the Coinbase contract with Cryptsy has an arbitration provision, and Coinbase sought to enforce that provision, the Receiver’s claims will proceed in arbitration.
“Coinbase wanted to stop the claims of the Class in Court pending the outcome of the arbitration, and the Court said no”, explained Mr. Sallah, who also is an attorney who often serves in the role of receiver in these types of actions. Sallah remarked that the litigation of cryptocurrency disputes are cutting edge issues in the courts, and that he is committed to working to help recover money for the victims of the Cryptsy fraud.
Information about both cases is available at www.cryptsysettlement.com and www.cryptsyreceivership.com

This page is provided for informational purposes and outlines who was eligible for the settlement, how the case proceeded, and what options may still exist for victims of cryptocurrency fraud.

If you are a CRYPTSY account holder and are unable to access your CRYPTOCURRENCY, you could get money from two different class action settlements
On August 25, 2016, the Honorable Kenneth A. Marra of the United States District Court for the Southern District of Florida entered an order certifying a class of Cryptsy account holders who are unable to access their cryptocurrency in a class action lawsuit.
The class action lawsuit claims that Defendant Project Investors, Inc. d/b/a Cryptsy (“Cryptsy”) and Paul Vernon stole and converted for their own use the cryptocurrencies of the Cryptsy account holders.
On April 24, 2016, the Court also appointed James D. Sallah, not individually but solely in his capacity as the Court-appointed Receiver, to act as the Receiver in this matter. The Receiver took control of Cryptsy, and worked with the lawyers for the plaintiffs in this class action to recover monies and assets for the Cryptsy account holders, which are part of the Settlements.
You are a member of the Class if you are a Cryptsy account owner who held Bitcoins, alternative cryptocurrencies, or any other form of monies or currency at Cryptsy as of November 1, 2015, through June 2, 2017, and are unable to access your cryptocurrency. All employees of Cryptsy, including its shareholders, officers and directors and members of their immediate families, are excluded from the Class.
Certain of the defendants have settled, and the litigation is proceeding against the remaining defendants.
The deadline to make a claim in the settlement is May 17, 2017.

Have you recently encountered financial struggles and searched the Internet for “fast cash” options? If you are a retired public employee, civil service worker, or military veteran who was recently offered money for selling your federal pension plan or income stream, you could be the next target of a growing loan-sharking scheme hitting the Internet today.

The Offer

The tagline on the company websites and advertisements promise “Money Now” and look like an easy way to receive fast cash in exchange for the purchase of a federal pension plan. However, these companies fail to disclose that this new financial contract is really a high-interest loan and charges interest rates that are more than double, or even triple, the amount of the cash advance originally received. For example, to receive a cash advance of $5,000, you could end up agreeing to pay up to $25,000 in interest over the term of your loan, which is usury! Companies, such as Future Income Payments, LLC; Pension Funding, LLC; Pension Income, LLC; and Pension, Annuities t Settlements, are offering such “pension advances,” a transaction in which retirees receive a lump sum cash payment for selling all or a portion of their pension payments.

What is Usury?

All states have usury laws, which regulate the amount of interest that may be lawfully charged on a monetary loan and prevent creditors from deceiving potential customers about hidden interest rates and fees. If a creditor attempts to charge an unfair interest rate higher than that regulated value, or has failed to make certain disclosures about the terms of the loan, the loan is deemed “usurious” and illegal and may then be cancelled and declared unenforceable by a court. Additionally, the interest paid on the contract will be returned to the victimized borrower—sometimes even at double or triple the amount as compensation for the legal violation against him or her, depending on the state’s law.

Additional Legal Protections

Federal law also protects citizens of all states from these deceptive and predatory lending practices:

The Truth in Lending Act (TILA) provides that companies must disclose the amount financed, the finance charge, the annual percentage rate, the total number and amount of payments “clearly conspicuously” in writing so that the borrower can make an informed decision regarding the credit being offered.

The Fair Debt Collection Practices Act (FDCPA) prevents abusive and harassing debt collection practices and allows consumers with remedies for any violations of this law.

The Electronic Funds Transfer Act (EFTA) prohibits any company from conditioning the extension of credit on a borrower’s repayment by preauthorized EFTs, such that the borrower is unable to stop repayment on a loan.

These protections ensure that all companies nationwide must abide by certain restrictions on monetary lending and protect individual rights of all American citizens by making it a federal crime to engage in deceptive loan practices.

How to Get Help

Xarelto Bleeding and Stroke Lawsuits

Have you or a loved one suffered severe bleeding or stroke after taking Xarelto?

If you have experienced adverse health effects or lost a loved one who took the blood-thinning medication Xarelto, you are not alone. The subject of a recent TV ad blitz starring Arnold Palmer, Xarelto has recently been linked to potentially fatal bleeding and stroke. Wites & Rogers is investigating and aggressively pursuing claims for compensation on behalf of those who have suffered after taking Xatelto.
Xarelto (rivaroxaban) was first approved by the FDA in July of 2011 to reduce the risk of blood clots and stroke in patients with atrial fibrillation, treat deep vein thrombosis and pulmonary embolisms, and reduce the risk of blood clots in patients undergoing knee or hip replacement surgery.
However, since its introduction a mere four years ago, Xarelto has become equally known for its potential side effects and serious health risks. Xarelto side effects are being reported at a rate of 2 to 1 over Pradaxa, the other new relatively new drug thinner on the market.
The most common risks associated with Xarelto include:

Uncontrollable abdominal bleeding

Abnormal liver function

Brain hemorrhage

Reduced platelet levels

Embolism

Death

A 2012 study published in the Journal of Bone and Joint Surgery also illustrated the increased risk of wound infections and complications for hip and knee replacement patients taking Xarelto. Despite these warning signs, many doctors and healthcare providers continue to prescribe Xarelto without thoroughly examining a patient’s risk status or explaining the enhanced risk level to patients.
Lawsuits are currently being filed on behalf of patients who have suffered serious side effects and adverse health consequences because of Xarelto, and new claims and reports of injury arise on a regular basis.
If you have questions or concerns about Xarelto, its side effects, and whether you may have a claim for compensation, please give us a call at 866-277-8631 or 954-933-4400, or contact us online to schedule a free consultation.

Wites & Rogers Files Class Action Lawsuit Against Cryptsy and Paul “Big Vern” Vernon

Wites & Rogers (www.wklawyers.com), along with the Silver Law Group, has filed a nationwide class action lawsuit in federal court against Florida-based cryptocurrency exchange operator Cryptsy and its principal, Paul (“Big Vern”) Vernon. Over the past several months, numerous Cryptsy account holders have been denied access to their accounts and have been deprived of any ability to properly protect their valuable assets amidst widespread reports of problems at the heart of Cryptsy’s business. While reports have been swirling in multiple media outlets that Cryptsy’s future is greatly troubled and that the company might be under heavy regulatory scrutiny, many Cryptsy account holders have been unable to withdraw any and all forms of currency from their accounts.
Despite repeated inquiries to Cryptsy, users are being left without any meaningful response or information from Cryptsy and have had their withdrawal demands either denied or tabbed as “pending” for days, weeks, or even months. Although the exact amount has yet to be calculated, it is believed the value of the digital funds being held captive at Cryptsy exceeds Five Million Dollars ($5,000,000.00).
The class action lawsuit is pending in the United States District Court for the Southern District of Florida under Case No. 9:16-cv-80060. As stated in the lawsuit, the class of victims pursuing relief includes “All Cryptsy account owners who deposited Bitcoins, alternative cryptocurrencies, or any other form of monies or currency at Cryptsy and have been denied access to their accounts and funds between November 1, 2015 and the present date.” The lawsuit asserts claims for negligence, unjust enrichment, conversion of funds and property, and violations of Florida’s Deceptive and Unfair Trade Practices Act.
