In my 30 years of practicing law...

I have always advised my clients to say NO until they were offered a fair and reasonable settlement or go to trial. However, it was only in 2024, after many courtroom battles representing the injured in cases big and small, in Florida and throughout the country, that I boiled down to this single phrase the description of the type of lawyer a client with a personal or financial injury needs; The Lawyer Who Says No.

The Lawyer Who Says NoTM is NOT the lawyer who decides when to say no and when to say yes to a settlement offer or the decision to go to trial. A lawyer’s job is to give advice and counsel; the case always belongs to the client, and the decision to say yes or no always belongs to the client. In other words, it’s your right, as the client, to tell your lawyer when to say yes and when to say no.
As the client, you have a right to a lawyer that will give you the right advice as to when to say no, that is not in your best interest. Whether to say yes or no depends on the unique facts of every case, such as how clear is it that the other person caused your injury, does the law support your claim, are there any bad facts in your case, how long will it take to resolve your case by settlement or trial, and how likely is it that the judge or jury will accept some or all of the arguments the defense is likely to make in arguing that they did not cause your injury and that even if they did your damages are overstated. For a lawyer to give you the right advice, the lawyer needs the experience, knowledge, resources, and integrity to give you the best advice as to whether to say no, and keep fighting, or yes and settle your case.

Any lawyer who has ever tried a case before a jury will tell you they have won cases they thought they would lose, lost cases they thought they would win, they have tried cases where the jury awarded less money than they asked for their client, and yes, sometimes the jury will award more money than you ask your client.

I have experienced all these events in my 30 years and counting, including a case where we asked the jury to award $10,000,000 to our client and the jury awarded $15,000,000 instead. No lawyer wins every case, and saying No comes with the risk that you and your lawyer might be wrong. But, saying No, and standing up for what’s right is what every client should want and deserve when they hire a lawyer to fight for their rights.
